1. About these terms
These Terms of Service ("Terms") are a binding agreement between you and CFATW LLC, a Wisconsin limited liability company doing business as LocalPost ("LocalPost," "we," "us," or "our"), governing your use of the LocalPost website at trylocalpost.com and the LocalPost web application (collectively, the "Service").
By creating an account, paying for a subscription, or using the Service in any way, you agree to these Terms. If you do not agree, do not use the Service.
2. Your account
To use the Service you must:
- Be at least 18 years old.
- Provide a valid email address you control.
- If signing up on behalf of a business, have authority to bind that business to these Terms.
- Keep your account credentials and email address secure. We use magic-link sign-in, which means anyone with access to your email can sign in to your account.
You are responsible for everything that happens under your account. Notify us immediately at hello@trylocalpost.com if you suspect unauthorized access.
3. Plans, trials, and billing
LocalPost offers two subscription plans:
- LocalPost (self-serve) — $99 per month, billed monthly.
- LocalPost Concierge — $249 per month, billed monthly. Includes the design service described in section 4.
14-day free trial. Each plan begins with a 14-day free trial. A valid payment method is required to start the trial. We will not charge you during the trial. On day 15, we will automatically charge your payment method the monthly price for the plan you selected unless you have canceled before that date.
Auto-renewal. After the trial, your subscription renews automatically each month and your payment method is charged the then-current price for your plan. By providing payment information, you authorize us (through our payment processor, Stripe) to charge that payment method on a recurring basis.
Price changes. We may change subscription prices going forward. We will notify you by email at least 30 days before any price increase takes effect. If you do not agree to the new price, you may cancel before the change takes effect.
Taxes. Prices are stated exclusive of any applicable sales taxes, which we will add to your invoice where required by law.
4. Concierge plan specifics
If you subscribe to the Concierge plan, the following additional terms apply:
- Scope. Up to twelve (12) custom post graphics per calendar month, designed by our team based on the briefs generated for your business.
- Revisions. One (1) round of revisions is included per design. Additional revisions are billed at $10 per round.
- Turnaround. We aim to deliver finished graphics within three (3) business days of the brief being approved. Turnaround may be longer for complex briefs or during high-demand periods.
- Overage. Designs beyond the 12-per-month allotment are billed at $15 per design.
- What's not included. Custom photography, video production, paid ad design, motion graphics, logo design, and full brand identity work are excluded from the Concierge plan.
- Brand assets. You are responsible for providing reasonable brand assets (logos, brand colors, photos) for our team to use. Designs may be lower quality if we lack source material.
- Unused designs. Unused monthly design allotments do not roll over.
5. Cancellation and refunds
You may cancel your subscription at any time through the billing portal accessible from inside the Service. Cancellation takes effect at the end of your current paid billing period — you will retain access until then.
Refunds. We do not provide refunds for partial months, unused features, or unused Concierge design allotments. If you believe you have been charged in error, contact hello@trylocalpost.com within 30 days of the charge and we will review in good faith.
Failed payments. If a recurring charge fails, we will retry it for up to 14 days. If payment cannot be collected, we will downgrade or suspend your account. Reactivating requires successful payment.
6. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Post, schedule, or generate content that is illegal, fraudulent, harassing, defamatory, hateful, sexually explicit, or that infringes someone else's intellectual property.
- Send spam or unsolicited commercial messages.
- Reverse engineer, scrape, copy, resell, or sub-license the Service.
- Attempt to gain unauthorized access to other accounts, our systems, or any part of the Service.
- Upload malware or otherwise interfere with the operation of the Service.
We reserve the right to remove content or suspend accounts that violate these rules, with or without notice.
7. Your content and our license to use it
You retain all ownership rights in the content you upload to LocalPost — your business information, brand context, photos, logos, captions, post text, and any other materials ("Your Content").
You grant LocalPost a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, transmit, display, modify, and process Your Content solely for the purpose of providing the Service to you. This includes sending Your Content to our third-party processors (such as Anthropic for AI generation and Supabase for storage) where necessary to operate the Service.
You represent and warrant that you have all rights necessary to grant this license and that Your Content does not infringe anyone else's rights.
8. Service availability
We strive for high availability but do not guarantee uninterrupted access. The Service may be unavailable from time to time due to maintenance, third-party outages (including Supabase, Stripe, Netlify, Anthropic, Resend, and others), or events outside our control. We do not provide service-level credits or refunds for downtime.
9. Changes to the service or terms
We may modify, add, or remove features at any time. We may also modify these Terms; if we do, we will post the updated Terms with a new "Last updated" date and, for material changes, notify you by email at least 14 days before they take effect. Continued use of the Service after the effective date of an updated version constitutes acceptance.
10. Termination
You may terminate your account at any time by canceling your subscription and emailing us to request deletion of your data.
We may suspend or terminate your account, with or without notice, if you violate these Terms, fail to pay, or use the Service in a way that creates legal or operational risk for us. Upon termination, your right to use the Service ends immediately. We will retain or delete Your Content as described in our Privacy Policy.
11. Disclaimers and limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI-generated content. We do not warrant that the Service will be uninterrupted, error-free, secure, or will produce specific marketing or business results.
To the maximum extent permitted by law, in no event will LocalPost, CFATW LLC, or our officers, members, employees, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the Service.
Our total liability to you for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
12. Indemnification
You agree to defend, indemnify, and hold harmless LocalPost and CFATW LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any third party's rights.
13. Governing law and disputes
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Milwaukee County, Wisconsin, and you consent to personal jurisdiction in those courts.
You and we each waive any right to a jury trial. Either party may seek injunctive relief in any court of competent jurisdiction to prevent infringement of intellectual property or unauthorized use of the Service.
